Welcome to Gex App (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile application, website, and related services (collectively, the “Services”).
By using our Services, you agree to comply with and be bound by these Terms. Please read them carefully before proceeding.
If you do not agree with these Terms, please do not use our Services.
1. Eligibility
To use Gex App, you must:
Be at least 18 years old.
Have full legal capacity to enter into binding agreements.
Use the Services only for lawful purposes and in compliance with all applicable laws and regulations, including New Zealand’s Anti–Money Laundering and Countering Financing of Terrorism (AML/CFT) Act.
2. Services Overview
Gex App provides digital currency exchange services, allowing users to exchange between New Zealand Dollar (NZD), Chinese offshore Yuan (CNH), and Tether (USDT).
All transactions are processed in partnership with iEpay, a licensed financial service provider.
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.
3. Account Registration and Verification
To access our Services, you must create an account and complete our identity verification process.
You agree to provide accurate, complete, and up-to-date information at all times.
We may suspend or terminate your account if we suspect that the information provided is false, misleading, or incomplete.
4. Compliance and Restrictions
You agree not to use the Services for:
Money laundering, terrorist financing, or other illegal activities.
Circumventing transaction limits or verification requirements.
Engaging in any fraudulent, abusive, or harmful behavior toward other users or Gex App.
We may report suspicious activities to regulatory authorities where required by law.
5. Fees and Exchange Rates
Transaction fees and applicable exchange rates will be displayed before you confirm any exchange.
By proceeding with a transaction, you agree to the fees and rates shown at that time.
All fees are non-refundable once the transaction has been processed, except where required by law.
6. Risk Acknowledgement
You understand and acknowledge that:
The value of currencies and digital assets such as USDT may fluctuate.
We do not guarantee any profit, return, or fixed exchange rate.
You are responsible for understanding the risks associated with currency and digital asset transactions before using our Services.
7. Limitation of Liability
To the maximum extent permitted by law, Gex App and its partners (including iEpay) are not liable for:
Any indirect, incidental, or consequential damages resulting from your use of the Services.
Losses due to network issues, system downtime, unauthorized access, or user error.
Losses arising from third-party services or blockchain network failures.
Your sole remedy for dissatisfaction with the Services is to stop using them.
8. Intellectual Property
All trademarks, logos, text, graphics, and software used within Gex App are owned by or licensed to us.
You may not copy, modify, or redistribute any part of the Services without our written consent.
9. Termination
We may suspend or terminate your account at any time, with or without notice, if:
You violate these Terms or applicable laws.
We detect suspicious or fraudulent activity.
We are required to do so by regulatory authorities.
You may also request account closure by contacting our support team.
10. Changes to These Terms
We may update these Terms from time to time.
Any changes will be posted on our app or website with the updated “Effective Date.”
Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
